- les appels successifs pour éviter le nouveau procès ont été écartés par les cours ; l'avocat général s'est retiré de l'affaire et la renvoie au procureur local. Le procès qui devait avoir lieu au printemps prochain pourrait être à nouveau reporté du fait de ces dernier bouleversements.

Rappel : la cour fédérale a renversé la condamnation d'Anthony Graves le 3 mars 2006.

[4 Mars 2006] TRES BONNE NOUVELLE !!!!!! La Cour fédérale du 5ème circuit vient de rejeter la décision de la Cour de District de Galveston et déclare que les deux témoignages de Robert Carter non divulgués par le procureur Sebesta au procès, étaient particulièrement importants car l'acusation d'Anthony Graves reposait presque entièrement sur le témoignage de Carter et qu'il n'y avait aucune preuve directe le liant à Carter où aux meurtres. La cour accorde donc le "writ of habeas corpus" qui devrait conduire à un nouveau procès sauf si l'Etat fait appel de cette décision dans les 180 jours. [March 4, 2006] VERY GOOD NEWS !!!!! The 5th Circuit Court has just reversed the judgement of the District Court of Galvestion and stated that the two Carter's statements, that were not disclosed by the District Attorney at the trial, "are particularly important in this case because Graves' conviction rests almost entirely on Carter's testimony and there is no direct evidence linking him with the murder scene other than Carter's testimony". The Court grants the writ of habeas corpus that may lead a new trial unless the States appeals the decision in 180 days.
